OVERVIEW
Welcome to CardMules.
CardMules LLC (“CardMules,” “we,” “us,” or “our”) operates this store and website, including all related information, content, features, tools, products, and services offered through CardMules (collectively, the “Services”). CardMules is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when you access or use the Services or purchase products from CardMules.
Please read these Terms carefully. They contain important information concerning your legal rights, purchases, product availability, pre-sales, warranties, and limitations of liability.
By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use the Services.
SECTION 1 – ACCESS AND ACCOUNTS
By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you are the age of majority and have given consent for your minor dependents to use the Services on devices you own, purchase, or manage.
To use certain portions of the Services or purchase products, you may be asked to provide information such as your name, email address, billing information, payment information, shipping information, or other account information.
You represent that the information you provide is accurate, current, and complete and that you have the right to provide such information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person without our permission.
SECTION 2 – PRODUCTS, COLLECTIBLES, AND PRODUCT INFORMATION
CardMules sells products that may include trading cards, sports cards, trading card game products, graded cards, sealed products, memorabilia, hobby supplies, and other collectibles.
We make reasonable efforts to accurately display and describe our products. However, colors, appearance, dimensions, packaging, or other characteristics may appear differently depending on your device, screen settings, manufacturer changes, or other factors.
Product descriptions, images, specifications, configurations, packaging, release information, and availability may change without notice.
Individual Collectibles
When photographs of a specific individual collectible are provided, those photographs form an important part of the product description. Customers should review available photographs and descriptions before purchasing.
Raw or ungraded cards and other collectibles may contain manufacturing variations, print defects, surface imperfections, centering variations, edge or corner wear, or other characteristics associated with collectible products.
Unless expressly stated otherwise, CardMules does not guarantee that an ungraded item will receive any particular grade if submitted to a third-party grading service.
Graded Collectibles
Grades, authentication determinations, labels, and related opinions issued by third-party grading or authentication companies are the determinations of those third parties.
CardMules does not independently guarantee a third-party grade, authentication determination, population report, or future re-grade result.
Sealed Products
Sealed trading card products may contain randomly inserted cards or other items.
Unless expressly stated otherwise, CardMules does not guarantee any particular card, pull, hit, autograph, parallel, rarity, grade, monetary value, or other result from opening a sealed product.
Published odds, checklists, configurations, and product information supplied by manufacturers are subject to the manufacturer's terms, production processes, and potential changes.
Market Value
Collectibles can fluctuate significantly in market value.
CardMules does not guarantee the current or future market value, resale value, investment performance, collectability, scarcity, or appreciation of any product.
A change in market value after an order has been accepted does not, by itself, change the agreed purchase price or create a right to cancel or reprice the transaction.
All product descriptions and offerings are subject to change, correction, or discontinuation as permitted by these Terms and applicable law.
SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase products from CardMules.
CardMules reserves the right to accept or decline an order as permitted by applicable law. An automated order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance if an inventory, payment, pricing, fraud, technical, allocation, or other material issue is subsequently identified.
Payment must be authorized and processed before an order can be fulfilled.
Please review your order carefully before submitting it. Cancellation requests may not be possible once an order has entered processing or fulfillment.
If CardMules needs to modify, decline, or cancel an order, we will make reasonable efforts to notify you using the contact information associated with the order. If CardMules cancels an order after payment has been collected, amounts paid for the canceled products will be refunded as appropriate.
Purchases are subject to our Return & Refund Policy, Shipping & Pickup Policy, Pre-Sale Policy where applicable, and other policies posted through the Services.
SECTION 4 – PURCHASE LIMITS AND FAIR ACCESS
Certain products may be subject to purchase limits because of limited availability, manufacturer or distributor allocations, promotional rules, pre-sale restrictions, or our efforts to provide reasonable customer access to high-demand products.
Purchase limits may apply per product, order, customer, household, account, payment method, address, promotional period, or other reasonable basis disclosed by CardMules.
Customers may not intentionally circumvent purchase limits through multiple accounts, coordinated orders, automated purchasing tools, false information, or other methods designed to defeat an announced restriction.
CardMules reserves the right to decline, reduce, or cancel orders that reasonably appear to circumvent purchase limits, involve fraud or abuse, or violate an applicable promotion or product restriction.
Any resulting refund will be processed in accordance with applicable law and our policies.
SECTION 5 – PRE-SALES AND FUTURE-RELEASE PRODUCTS
Certain products may be offered for purchase before their official release or availability date (“Pre-Sale Products”).
A stated release date represents the expected release date based on information available to CardMules at that time. Release dates may be changed by manufacturers, distributors, licensors, publishers, or other parties outside CardMules' control.
Purchasing a Pre-Sale Product does not guarantee that a manufacturer or distributor will release or deliver the product to CardMules on the originally anticipated date.
Manufacturer or distributor allocations may also be modified, delayed, reduced, or canceled.
If circumstances outside our reasonable control materially affect our ability to fulfill a Pre-Sale Product, CardMules may delay fulfillment, contact affected customers regarding available options, reduce quantities where reasonably necessary, or cancel and refund affected items as appropriate and permitted by applicable law.
Pre-Sale Products will not be available for fulfillment before the applicable release date unless CardMules expressly states otherwise.
Some Pre-Sale Products may be designated for in-store pickup only. Where a product is identified as pickup only, purchasing the product does not create a right to have that product shipped.
Not every product CardMules receives or expects to receive will necessarily be made available for pre-sale. CardMules determines which products qualify for pre-sale and may establish different quantities or purchase limits for different products.
Additional terms displayed on a Pre-Sale Product page or contained in our Pre-Sale Policy are incorporated into these Terms.
If there is a conflict between general provisions of these Terms and specific disclosed terms applicable to a Pre-Sale Product, the specific Pre-Sale Product terms will control to the extent permitted by law.
SECTION 6 – PRICES, BILLING, AND PROMOTIONS
Prices, discounts, and promotions may change without notice.
The price charged for a product will generally be the price in effect when the order is placed and shown in your order confirmation, subject to correction of genuine pricing, listing, or technical errors as described in these Terms.
Unless expressly stated otherwise, posted prices do not include applicable taxes, shipping, handling, customs, duties, or import charges.
Prices available through the CardMules website may differ from prices offered in our physical store, marketplaces, events, third-party platforms, or other sales channels.
Promotions may be governed by additional terms and conditions. If specific promotional terms conflict with these Terms, the promotional terms will control for that promotion.
You agree to provide current, complete, and accurate payment and account information.
You represent that you are authorized to use the payment method submitted and agree to pay all properly authorized charges associated with your purchase.
SECTION 7 – SHIPPING, DELIVERY, AND IN-STORE PICKUP
Shipping, delivery, and in-store pickup are subject to our Shipping & Pickup Policy and any fulfillment restrictions displayed for a particular product.
Delivery dates and transit times are estimates unless expressly guaranteed. CardMules is not responsible for delays caused by carriers, severe weather, natural disasters, customs processing, manufacturer or distributor delays, incorrect customer information, or other circumstances outside our reasonable control.
Customers are responsible for providing complete and accurate shipping and contact information.
Certain products, including some Pre-Sale Products, may be available only for in-store pickup.
Products designated for in-store pickup must be collected from the designated CardMules location in accordance with the instructions provided with the order.
An order confirmation does not necessarily mean an order is ready for pickup. Customers should wait until CardMules communicates that the order is available for pickup.
Additional shipping, delivery, lost-package, damaged-package, and pickup procedures may be described in our Shipping & Pickup Policy.
SECTION 8 – RETURNS, REFUNDS, AND CANCELLATIONS
Returns, refunds, exchanges, and cancellations are governed by our Return & Refund Policy and any product-specific terms disclosed before purchase.
Because CardMules sells collectibles, sealed products, individual cards, graded cards, and limited-availability merchandise, eligibility for returns or exchanges may differ depending on the type and condition of the product.
Customers should review the Return & Refund Policy before completing a purchase.
Nothing in these Terms or our policies limits rights that cannot legally be waived under applicable consumer-protection law.
SECTION 9 – REWARDS, LOYALTY PROGRAMS, AND PROMOTIONS
CardMules may offer loyalty programs, rewards, points, discounts, early access opportunities, promotional offers, or similar benefits.
Such programs may be subject to separate rules, eligibility requirements, expiration provisions, purchase restrictions, or promotional terms disclosed through the applicable program.
Rewards, points, discounts, promotional benefits, or early-access opportunities do not represent cash or property unless expressly stated otherwise and may not be transferable.
CardMules may modify or discontinue a rewards or promotional program subject to applicable law and any specific terms governing that program.
Attempts to manipulate, exploit, duplicate, fraudulently obtain, or improperly redeem rewards or promotional benefits may result in cancellation of the affected benefits, orders, or participation in the applicable program.
SECTION 10 – INTELLECTUAL PROPERTY
Our Services, including trademarks, branding, text, graphics, photographs, videos, audio, website design, original content, and the selection and arrangement thereof, are owned by CardMules, our affiliates, or our licensors, as applicable, and are protected by applicable intellectual property laws.
These Terms permit you to use the Services for personal, non-commercial purposes.
Except as permitted by law or with our prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or commercially exploit CardMules-owned content.
Nothing in these Terms grants you a license or other ownership right in CardMules, Shopify, or third-party intellectual property.
CardMules names, logos, designs, and slogans owned by CardMules may not be used without appropriate permission.
Shopify's names, logos, products, and services are trademarks of Shopify as applicable.
Other names, logos, products, characters, trading card properties, leagues, manufacturers, licensors, and trademarks appearing through the Services remain the property of their respective owners. Their appearance on CardMules does not imply ownership by CardMules.
SECTION 11 – OPTIONAL AND THIRD-PARTY TOOLS
The Services may provide access to tools, applications, integrations, payment services, rewards services, analytics services, or other functionality provided by third parties.
Such tools may be provided “as is” and “as available” and may be governed by the third party's own terms and privacy practices.
Your use of third-party tools is at your discretion, and you should review applicable third-party terms where appropriate.
CardMules may introduce, modify, or discontinue features, tools, integrations, and resources from time to time. New features offered through the Services will generally be considered part of the Services and subject to these Terms.
SECTION 12 – THIRD-PARTY LINKS
The Services may contain links to or functionality provided by third-party websites, platforms, manufacturers, marketplaces, social networks, service providers, or other third parties.
CardMules is not responsible for examining or guaranteeing the content, accuracy, availability, security, or practices of independent third-party websites.
If you leave the Services to access a third-party website or service, you do so subject to that third party's terms and policies.
Questions or claims relating specifically to products or services supplied independently by a third party should be directed to that third party where appropriate.
SECTION 13 – RELATIONSHIP WITH SHOPIFY
CardMules is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with CardMules.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and CardMules, including any injury, damage, or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with CardMules.
SECTION 14 – PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information related to your access to and use of the Services in order to provide and improve Shopify's services.
Information submitted through the Services may be processed by Shopify and other service providers as described in our Privacy Policy.
Please review the CardMules Privacy Policy for additional information concerning how personal information is collected, used, disclosed, and protected and how you may exercise applicable privacy rights.
SECTION 15 – FEEDBACK, REVIEWS, AND USER CONTENT
If you voluntarily submit, upload, post, email, or otherwise transmit ideas, suggestions, feedback, reviews, photographs, proposals, or other content (“Feedback”), you grant CardMules a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback for purposes related to operating, improving, and promoting the Services, subject to applicable law.
You represent that you own or possess the necessary rights to content you submit and that your submission does not violate another person's intellectual property, privacy, publicity, or other legal rights.
You are responsible for the accuracy and legality of content you submit.
CardMules may moderate or remove Feedback that we reasonably determine violates these Terms, applicable law, or the rights of others.
SECTION 16 – ERRORS, INACCURACIES, INVENTORY, AND AVAILABILITY
Despite reasonable efforts to maintain accurate information, the Services may occasionally contain typographical errors, incorrect photographs, inaccurate product descriptions, pricing errors, inventory discrepancies, incorrect shipping information, release-date errors, promotional errors, or other inaccuracies.
Inventory displayed online may also be affected by simultaneous purchases, in-store sales, marketplace sales, system synchronization, manufacturer or distributor allocations, or technical issues.
CardMules reserves the right, as permitted by applicable law, to correct genuine errors or inaccuracies, update information, modify availability, or cancel affected orders when necessary.
If CardMules cancels a paid order because of a material pricing, inventory, availability, or listing error, amounts collected for the canceled products will be refunded.
CardMules will not intentionally use this provision simply to cancel an otherwise valid completed sale because the secondary-market value of a collectible subsequently increased.
SECTION 17 – PROHIBITED USES
You may access and use the Services only for lawful purposes.
You may not use the Services to violate applicable law; infringe intellectual property or other legal rights; harass, threaten, defame, abuse, or harm others; transmit false or misleading information; impersonate another person; transmit malicious software; interfere with the operation or security of the Services; collect personal information unlawfully; send spam or unauthorized solicitations; or engage in fraudulent or abusive activity.
You may not use bots, scripts, automated purchasing systems, scraping tools, agents, or other automated processes to circumvent purchase limits, manipulate inventory availability, obtain an unfair purchasing advantage, abuse rewards or promotions, interfere with checkout, or bypass security or access restrictions.
You may not intentionally evade product quantity restrictions through multiple accounts, identities, addresses, payment methods, coordinated purchasers, or other means.
CardMules reserves the right to restrict access, suspend accounts, decline transactions, or cancel affected orders when we reasonably determine that these Terms have been violated, subject to applicable law.
SECTION 18 – AUTOMATED AGENTS
This section applies if you use or cause an autonomous or semi-autonomous software agent (“Agent”) to access or interact with the Services.
Agents may not conceal their automated nature, circumvent CAPTCHAs or other technical restrictions, bypass measures designed to control automated access, manipulate purchases or inventory, or otherwise access the Services contrary to technical restrictions or these Terms.
CardMules may limit or block automated access to protect customers, inventory, systems, and the integrity of the Services.
SECTION 19 – TERMINATION
CardMules may suspend or terminate access to the Services where reasonably necessary because of violations of these Terms, fraud, abuse, security concerns, unlawful conduct, or other legitimate business or legal reasons.
Termination does not eliminate obligations incurred before termination.
Provisions that by their nature should survive termination—including intellectual property, payment obligations, limitations of liability, indemnification, governing law, and related provisions—will continue to apply.
SECTION 20 – DISCLAIMER OF WARRANTIES
Information presented through the Services is provided for general informational and commercial purposes.
While CardMules makes reasonable efforts to provide accurate information, we do not guarantee that all content will always be complete, current, uninterrupted, or error-free.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR WARRANTIES OR RIGHTS THAT CANNOT LEGALLY BE DISCLAIMED, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, OR NON-INFRINGEMENT.
Nothing in this section excludes warranties or consumer rights that cannot legally be excluded.
SECTION 21 – LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CARDMULES LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR SIMILAR DAMAGES, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT LEGALLY BE LIMITED.
THE LIMITATIONS IN THIS SECTION APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
Nothing in these Terms is intended to limit liability or legal rights where such limitation is prohibited by law.
SECTION 22 – INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless CardMules LLC, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, damages, liabilities, losses, and reasonable attorneys' fees arising from your material violation of these Terms, violation of applicable law, violation of a third party's rights, or misuse of the Services.
CardMules will provide reasonable notice of an indemnifiable claim where appropriate.
SECTION 23 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.
The remaining provisions will continue in full force and effect.
SECTION 24 – WAIVER; ENTIRE AGREEMENT; ASSIGNMENT
Failure by CardMules to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
These Terms, together with policies and product-specific terms incorporated by reference, constitute the agreement governing your use of the Services and purchases through the Services.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
CardMules may assign or transfer its rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, change of control, or other lawful business transaction.
SECTION 25 – GOVERNING LAW
These Terms and any dispute arising from or relating to the Services or transactions with CardMules will be governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Subject to applicable law, disputes that are properly brought in a state or federal court will be brought in a court of competent jurisdiction serving the location in Arizona where CardMules LLC is headquartered.
Nothing in this section limits any consumer right concerning jurisdiction or venue that cannot legally be waived.
SECTION 26 – HEADINGS
Headings are included for convenience and organization only and do not limit or otherwise affect the interpretation of these Terms.
SECTION 27 – CHANGES TO THESE TERMS
You may review the current version of these Terms at any time through the CardMules website.
CardMules may update these Terms from time to time to reflect changes to our Services, products, policies, business practices, technology, or legal obligations.
Material changes will be communicated where required by applicable law.
Changes become effective when posted or on the effective date otherwise identified in the applicable notice.
Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
